Top Fishing Destinations: Accommodation Listing Terms and Conditions

1. Eligibility to List

• • You must be legally entitled to list and rent out the accommodation you submit on the Platform.
• • You warrant that the information provided in your listing is accurate, complete, and not misleading in any way.
• • You are responsible for ensuring that your listing complies with all applicable local laws, regulations, zoning requirements, and tax obligations related to short-term rentals in Postmasburg, Northern Cape, South Africa, and any other relevant jurisdiction. This includes obtaining any necessary permits or licenses.
• • You must maintain adequate insurance coverage for your property that covers short-term rentals. Top Fishing Destinations is not responsible for providing insurance coverage for Hosts or their properties.

2. Listing Content and Accuracy

• • You are solely responsible for the content of your listing, including descriptions, photos, pricing, availability, amenities, house rules, and any other information provided.
• • You agree to keep your listing information accurate and up-to-date at all times. This includes promptly updating your calendar, pricing, and amenities if any changes occur.
• • Photos uploaded must be of high quality, accurately represent the current condition and features of your accommodation, and not be misleading. You warrant that you have the right to use all photos you upload.
• • You agree not to include any offensive, discriminatory, illegal, or misleading content in your listing.
• • Top Fishing Destinations reserves the right to remove or edit any listing that violates these terms or our general Terms of Service.

3. Pricing and Fees

• • You are solely responsible for setting your nightly rates, cleaning fees (if applicable), security deposit (if applicable), and any other applicable charges.
• • You agree to clearly display all applicable fees to potential guests before booking.
• • Top Fishing Destinations charges a service fee to guests on each booking. This fee is calculated separately and is visible to the guest during the booking process.
• • Top Fishing Destinations may also charge a service fee to Hosts for using the Platform. The current Host service fee will be communicated to you separately and may be deducted from your payout. You agree to pay this Host service fee.
• • You are responsible for determining and remitting any applicable taxes (such as VAT or tourism levies) related to your rental income in accordance with local regulations in Postmasburg, Northern Cape, South Africa, and any other relevant jurisdiction. Top Fishing Destinations may collect and remit certain taxes on your behalf where legally required, but this does not relieve you of your ultimate responsibility.

4. Booking and Cancellations

• • By listing your accommodation, you agree to honor confirmed bookings made through the Platform, subject to your stated cancellation policy.
• • You are responsible for setting your cancellation policy, which must be clearly displayed in your listing. You agree that your cancellation policy must be fair and reasonable for guests.
• • Top Fishing Destinations will facilitate the booking process and payment collection on your behalf, according to the agreed-upon terms.
• • In the event of a Host cancellation outside of your stated cancellation policy or due to reasons deemed unacceptable by Top Fishing Destinations, you may be subject to penalties, including but not limited to cancellation fees, negative reviews, and suspension from the Platform.

5. Host Responsibilities

• • You are responsible for providing a safe, clean, and habitable accommodation that matches the description in your listing.
• • You are responsible for ensuring that guests have access to the property as described and for providing clear check-in and check-out instructions.
• • You are responsible for addressing any issues or complaints raised by guests during their stay in a timely and professional manner.
• • You agree to comply with all applicable laws and regulations regarding the safety and accessibility of your accommodation.
• • You are responsible for maintaining open and effective communication with guests through the Platform's messaging system.

6. Reviews and Ratings

• • Guests will have the opportunity to leave reviews and ratings for your accommodation after their stay.
• • You acknowledge that these reviews and ratings are important for building trust and attracting future bookings.
• • You agree not to manipulate or incentivize reviews in any way.
• • Top Fishing Destinations reserves the right to remove reviews that violate our review guidelines.

7. Indemnification

You agree to indemnify and hold harmless Top Fishing Destinations, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your listing, your rental of your accommodation, your breach of these Terms and Conditions, or your violation of any applicable laws or regulations.

8. Termination

• • Top Fishing Destinations reserves the right to suspend or terminate your listing or your access to the Platform at any time, with or without cause, and without prior notice.
• • You may terminate your listing at any time by following the instructions on the Platform. However, you will remain responsible for honoring any existing bookings.

9. Governing Law and Dispute Resolution

• • These Accommodation Listing Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
• • Any disputes arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

10. Amendments

Top Fishing Destinations reserves the right to modify these Accommodation Listing Terms and Conditions at any time. We will notify you of any material changes by posting the updated terms on the Platform or by other reasonable means. Your continued listing of your accommodation after the effective date of any changes constitutes your acceptance of the revised terms.
